In the name of God amen. I Jacob YATES of the town of Schaghticoke county of Rensselaer and state of New York being in good mind and memory blessed be to God therefor do this tenth day of May one thousand eight hundred and thirty one make and publish this my last Will and testament in manner and form following that is to say.
Imprimus I command my body and soul into the hands of almighty God who gave me and my body to the earth from whence it came in hopes of a joyful resurrection through the merits of my Lord and savior Jesus Christ.
And as for my worldly estate wherewith it has pleased God to bless[?] me, I dispose thereof as follows:
First I give to my wife Elizabeth all my real and personal estate [during] her lifetime and as long she continues my widow.
Item: And the lot north of the lane being about ten acres is to be sold and if I do not see it in my lifetime then my executor will sell the same and give title for it and the money they sell it for is for the use of my wife as long as she lives, and if any left after her death to be divided among my six children. (wew)
Item: I give and bequeath to my son Peter one hundred acres of land in addition with the fifty acres which I gave him Deed for making his farm one hundred and fifty acres to him his heirs and assigns forever. To be as [?] as will admit, and for him to pay to the corporation of the city of Albany three bushels of wheat yearly and every year.

I give also to my son Peter after the death of my wife my Dutch Bible and my [?] clock.
Item: I give to my son Cornelius fifty acres of land in addition with what he now holds which will make one hundred acres to him and his heirs and assigns forever, excepting his son Jacob who is not to be an heir in the above land. I give to my son Cornelius in addition to the above land all my wearing apparel.
Item: I give and bequeath to my grandson Jacob and to his heirs and assigns son of Cornelius Yates fifty acres of land to join the land which I have given to his father which will make the whole between father and son one hundred and fifty acres.
Item: I give to my son Christopher in addition to what he holds from me by deed one hundred and twenty acres of land and to his heirs and assigns forever. Next south of the lane and north of the line which I have marked out across the old clearing and into the woods east so far as to make the above one hundred and twenty acres and for him Christopher to pay to the Corporation of the city of Albany three bushels and a half of good wheat yearly and every year.
Item: I give and bequeath to my son Abraham and to his heirs and assigns forever one hundred and fifty acres of land including the homestead with the buildings thereon, north along the line which I have made across the fields and on the south line of my land and Sakes Patent and east till it takes one hundred and fifty acres, and said Abraham to pay the Corporation of the city of Albany four bushels of good wheat yearly and every year. I give to my son Abraham two horses one wagon one slay [sleigh] one plough and one harrow. The line between Christopher and Abraham is where the fence is new made in part and when it is whole made the above four farms will contain six hundred acres. (wew)
Item: I reserve two acres for burial ground taken on both the old and new and to extend it east if it is needed.
Item: I give and bequet to my daughter Maria the house and lot where she now lives and to her heirs and assigns forever.
Item: I give and bequet my daughters Maria and Sarah each twenty five acres of land on the east line of my woodland and to their heirs and assigns forever. I give my two daughters Mariah and Sarah all of my household furniture, after the death of my wife Elizabeth. It is my request and order that my son Peter shall have the three books which have been presented to me by Henry G. Yates.
Item: If any of my woodland is left after the six hundred and fifty acres are measured then the remainder to be divided among my four sons.
I hereby nominate constitute appoint and ordain my beloved wife Elizabeth, Peter J. Yates, Christopher J. Yates and my friend Garet Y. Lansing of the city of Albany as executrix and executors to this my last Will and testament.
In witness wereof I the said Jacob Yates have affixed my seal and subscribed my name this twelfth day of May in the year of our Lord one thousand eight hmdred and thirty one and in the fifty fifth year of the American Independence. (wew)
