The last Will and Testament of Alonzo N. Kinney late of the town of North Greenbush County of Rensselaer deceased together with the proofs thereof as a will of real & personal estate. Received December 20th 1893.

I Alonzo N. Kinney of the town of North Greenbush in the County of Rensselaer and State of New York do make publish and declare this my last will and Testament as follows: Namely:

First I give devise and bequeath all my estate real and personal to my beloved wife for and during the term of her natural life provided she shall remain my widow but if she shall marry again then in such case from and after such marriage I give devise and bequeath the same excepting so much and such parts there of as the laws of the State entitle her to hold and retain: To my children in the proportions herein after specified.

Second From and after the decease of my wife or in case she shall marry again then from and after such marriage I give devise and bequeath to my son Sydney N. Kenney six thousand dollars and to my daughters Mary E. Copeland, Sarah L. Defreest and Ella E. Kenney each three thousand dollars but it is my Will that the amount of any and all notes held by me at the time of my death made by either one of them the said Sydney N., Mary E. and Sarah L. be deducted from the amount herein before given to him or her respectively My son Charles is not mentioned in this clause of my Will for the reason that I have recently at his request advanced him the sum of six thousand dollars being an amount equal to the foregoing bequest to his brother Sydney.

Third After providing for the payment of the several legacies hereinbefore specified and contained I give devise and bequeath all the rest and residue of my estate real and personal to my five children to be equally divided between them share and share alike. In case anyone of my said children shall die in my life time leaving issue or descendants I direct that his or her share shall not lapse but the same shall be paid to such descendants by my Executrix and Executor to wit: To all the children of the legatee in equal proportions if all his or her children shall be then living or if none of them have died leaving issue at the time of my death but if any of his or her children or descendants shall have died leaving issue then such issue or descendants to take the share or part of such legacy which the parent of such issue or descendants would have taken by this Will if living at the time of my death.

Fourth And lastly I appoint my son Sydney N. Kenney & my son-in-law Philip S. Defreest Executors and my wife Eliza Executrix of this my last Will and Testament hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand and seal this 19th day of March in the year one thousand eight hundred and sixty nine.

We whose names are hereto subscribed do certify that Alonzo N. Kenney the testator inscribed his name to the within instrument in our presence and in the presence of each of us. And at the time he declared in our presence and hearing that the same was his last Will and Testament and requested us and each of us to sign our names thereto as witnesses to the Execution thereof and which we have done accordingly in the presence of the testator and of each other the day of the date of the said will.
