The last will and testament of John W. Witbeck late of the town of East Greenbush in the County of Rensseler deceased. With the proofs thereof as a will of Real and Personal estate. Recorded April 10th 1865.

In the name of God Amen John W Witbeck of the town of East Greenbush Rensselaer County State of New York being weak in body but of a sound mind and memory Blessed be almighty God for the same considering the uncertainty of this mortal life I do make publish and declare this my last Will and testament in manner and form following to wit:

First, I will that all my debts funeral expenses and gravestones or monument for myself and my beloved wife Catherine be paid by my Executors hereafter named out of my personal property.

Second, I will and bequeath to my son William and to his heirs the farm I now live on & occupy in that is the part of the farm I bought of John Lansing from the west side of the division line between inc and my daughter Barbary wife of Henry W. Witbeck. And also that lot of land I bought of Peter J. Witbeck making one hundred and four acres being more or less with all the buildings and improvements on it reserving that part of the house I now live in from the front door all of the south side of the hall on the lower floor with tea room, kitchen, wood house and all what belongs to it and also part of the stone house and stable, part of the garden, part of the fruit, part of the dooryard and firewood, those reservations she must have as long as she lives. 1 also will her a good gentle horse single carriage cutter and a good set of single harness. Those reservations I will that my beloved wife Catherine shall have and enjoy them as long as she lives and also all my household furniture. I will that the remainder of my personal property after all my debts and expenses are paid by my executors shall be equally divided between my son William and my four daughters, Jane wife of Leonard Whyland, my daughter Barbary wife of Henry W Witbeck, my daughter Catherine wife of Chensey Payn and my daughter Elizabeth Ann wife of Martin P Defreest. If any of them are dissatisfied with my Will and make costs they shall have no part of my property.

Lastly I do nominate contstitute and appoint my son William, my son-in-law Leonard Whyland, my son-in-law Henry W. Witbeck Executors of this my last Will and testament.

Whereunto I set my hand and seal this thirtieth day of June in the year of our Lord one thousand eight hundred and sixty three.
